‘I want a share of my daughter’s estate’

A woman of Lusaka has asked a local court to revoke the appointment of her son-in-law as administrator of estate for his late wife.
Juliet Chama told the court that her son in-law Daniel Mukombwe 40, had failed to administer her late daughter’s estate because since her death in 2012 she had not been given her share as ordered by the court.
This was in case where Chama sued Mukombwe for revocation of  administrator after he allegedly failed to administer his late wife’s estate.
Evidence before the court was that Mukombwe’s wife died in 2012 leaving behind a boarding house. The court ordered that Chama should be getting 30 per cent from the rentals of the boarding house.
However, Chama submitted that although Mukombwe had been collecting the rentals, he had not been giving his mother in-law her share.
“Whenever I try to confront him, he gets upset and shouts at me. He says he is using the money to finish building the boarding house.
“Therefore, I want him to step down as an administrator, so that we choose someone who would manage to administer the estate accordingly,” she said.
But Mukombwe refused to step down citing that he built that house with his wife hence it was impossible for him to give to someone else to administer it.
He said the time his wife died the boarding house was not complete hence the K60,000 he had collected for two terms from the students he used it to finish building the structure.
When passing judgment magistrate Pauline Newa sitting with Shallon Sichone and Daniel Phiri dismissed the claim.

2 murder suspects accused of killing taxi drivers apply to change lawyer

TWO persons in a case they are jointly charged with five others accused of brutally  killing  two taxi drivers using a metal wire  have  applied to  the  court to change  legal representation claiming they have never seen their lawyer.
The  two  accused  persons  applied  to  Kabwe  High Court  Judge Elita  Mwikisa to  allow  them  change  their lawyer Tutwa Ngulube from Nanguzyambo Associates to  Legal  Aid.
This  is in a case in which  the  seven are  facing two counts of  murder, attempted murder and  aggravated  robbery.
Particulars of the offence were that in count one, the accused on September 12, 2012 in Kabwe stole from Simon Phiri a Toyota Corolla registration Number ABZ 1481 valued at K21,000.
In count two, the seven whilst acting together murdered Simon Phiri and in count three whilst acting together stole a motor vehicle from Aaron Hansanda a Toyota Sprinter registration number ABZ 3004 valued at K20,000.
In count four, they are facing murder charges for Hansanda, and in count five  two of the accused  on January 10,2013 in Kabwe whilst acting together assaulted Eugene Mulenga with intent to steal a motor vehicle namely Toyota Corolla Registration number ACR 6892 valued at K28,000 while armed  with a wire.
The seven have all pleaded not guilty to the charges.
But  when  the  case  came  up for the continuation of trial, Kingsley and Joseph applied to the  court  for change  of their  lawyers. The court  granted  the  application.
Police officers testified in court how the juvenile offenders lead them to the scene of the crimes.
Josephat Mukuba, 28,  of Kabwe Police station told the court that on January 11, 2013 around 01:00 hours, he received a phone call from an informer that some suspected criminals believed to be behind the killing of Taxi drivers were lodging at a house in Kabwe.
Mr Mukuba said he called for backup from the anti-robbery squad and went to the house where two juvenile suspects were picked up.
He said Eugene Mulenga a taxi driver who had been attacked that same night accompanied the police officers and identified the two as the ones that attacked him.
Mr Mukuba explained that after questioning the two over the killing of taxi drivers they lead the police where they had dumped two of the bodies of other taxi drivers they killed earlier using a wire and stolen vehicles from.
He told the court that the two lead the police officers to Kabwe’s Natuseko Site and Service at a place called Chidizi were they dumped the bodies in a stream.
Mr Mukuba added that the accused later  lead police officers to Ndola at a garage were the vehicles they stole were being dismantled and dragon wires were been made.
Nyambezi Zimba aged 45 narrated how on September 12, 2012 around 19:00 hours after supper, her son Simon Phiri left home for his night shift as a taxi driver.
Zimba said her son used to work in the night and he usually went back home around 07:00 hours the following day. But on that day, he did not show up and that the following morning, she went to sell local brew unknown as Munkoyo.
She said on her return later in the afternoon, she went back home and was shocked to find a number of people at her house and that’s how she learnt that her son had been killed.
Zimba said she went to Kabwe General Hospital Mortuary and identified her son whose body was  swollen up and had a dragon wire across the  neck.

Zambian Teacher petrol-bombs himself at a Guest House.

WHAT could have been a thriving Saturday for Choma residents turned up to be an awful day after a teacher from a school in Chief Chikanta’s area allegedly petrol-bombed himself in a Guest House.
The incidence happened at Muntu Wabulonga Guest House located in the heart of Choma business district adjacent to Arupee Service Station.
The deceased was only identified as Mr Mwiinga by some residents found at the scene, was from a school in Chikanta chiefdom. His age was unknown.
By Press time, Southern Province Police Commissioner Mary Chikwanda said, she had only heard about the incidence but had no further details.
“I am still awaiting details from my officers which I would be able to give afterwards,” Ms Chikwanda said when reached for a comment.
But according to the eye-witnesses, the deceased killed himself in a suspected suicide mission in the early hours of yesterday.
The eyes witness found at the guest house where the incident happened around 07:00 hours, said the deceased’s face and eyes were severely burnt.
A TIMES reporter who rushed to the scene around 07:20 hours found on-lookers scavenging in the debris after the fire swept through the room.
Muntu Wabulonga Guest House proprietor Mavis Mweemba said the deceased booked a room on Friday around 18:30 hours and was reportedly drunk.
Ms Mweemba, who was visibly shaken said, in the morning yesterday around 06:40 hours, one of the security guards saw Mr Mwiinga leaving the guest house.
She said Mr Mwiinga was reportedly still in a drunken state and that nobody knew where he was going because he had settled his bills when he booked the room.
She said the guard even talked to the deceased who later returned with a container of petrol and went straight into his room.
Ms Mweemba said the deceased came back to his room while smoking, entered the room and locked himself inside.
She said minutes after Mr Mwiinga entered the room, a guard noticed smoke coming  from the room.
After being alerted by the guard, the fire brigade was called in and arrived at the scene a few minutes later. By then, she and other people had started breaking the door.
Ms Mweemba said they found the deceased severely burnt. She described the incidence as shocking adding that it was the first time that such an incidence had happened since the inception of the lodge in the 1990s.
The fire which engulfed the entire room destroyed a single bed, blankets, a mattress, a television set worth thousands of kwacha and the deceased’s items.
The body was taken to Choma Hospital mortuary awaiting identification by relatives from Chief Chikanta’s area.

My mother-in-law has taken over my house duties, husband prefers educated spouse

A WOMAN of Ndola has told the Ndola Main Local Court that her mother-in-law started preparing her husband’s food and bathing water when they moved into her house.
She said this forced her to move back to her parents’ home because the situation was not conducive for her.
Miriam Mwewa, 25, told Principal Presiding Magistrate Sara Bwalya, sitting with senior local court Magistrate Kaala Nyambe and Dismas Katambi that she wished to be divorced from her husband Dickson Zimba, 32, an employee of Zambia International Trade Fair (ZITF).
Mwewa sued her husband for divorce.

She told the court that the two got married in 2003 although Zimba did not pay dowry and the two have four children together.
Mwewa said the two used to live happily until 2008 when Zimba was employed at ZITF as a metal fabricator.
She said her husband started telling her that he wanted to marry someone who was educated because she was an illiterate.
“When he got a job he started dating his workmate whom he has since married and has already paid her dowry while mine was not paid,” Mwewa said.
She said last October, the couple moved to the house of her mother-in-law and their living environment was not conducive. The couple quarrelled most of the times and her mother-in-law started cooking for her son.
Mwewa said she was forced to return to her parents and before long, Zimba moved in with his new lover.
She said she did not wish to remain married to him when he married another woman.
But Zimba refused to divorce his wife, saying he still wanted to have her as his wife.
“I don’t want the marriage to end, I want to have them both as my wives,” he said.
But Magistrate Katambi granted the divorce, saying if Zimba wanted Mwewa to remain his wife, he would have been living with her or at least visit her.
He said it was not right for Zimba to abandon his wife and move in with someone else.
Divorce was granted and the court ordered Zimba to pay Mwewa K15,000 as compensation with K1,000 as a first instalment and later K500 monthly.
“Divorce is granted, Mwewa is still young and she can marry someone else who will love her,” Magistrate Katambi said.

 

Decoding the Apple-Samsung patent dispute

Apple and Samsung are suing each other in courts and trade offices around the world, each making claims that the other copied patented mobile device features.

The companies’ most-recent legal tussle all but concluded on Friday, when a California jury found that Samsung copied some of Apple’s smartphone features. The panel also concluded that Apple illegally used one of Samsung’s patents in creating the iPhone 4 and 5.

All told, the jury awarded Samsung $158,400 and Apple $119 million, far less than the $2.2 billion the company sought.

Jurors were ordered to return to court Monday to continue deliberations on a minor matter that could result in a higher award for Apple.

Before determining whether the companies copied phone technologies, jurors had to consider several patents. Here’s a look at select patents and the jury’s conclusions:

Patent 5,946,647

—Official description: System and method for performing an action on a structure in computer-generated data.

—What it really means: In a mobile device, the technology described in this patent is used to display a pop-up menu of options. One example: When you highlight a phone number on the touchscreen and the software gives you a prompt of options.

—The jury’s verdict: The jury found that Apple proved Samsung infringed on the patent across several mobile devices, including the Galaxy Nexus, Galaxy S III and Stratosphere.

Patent 6,847,959

—Official description: Universal interface for retrieval of information in a computer system.

—What it really means: This patent covers a process that’s similar to the function of a search engine. It enables the mobile device to access information from a variety of locations, while only listing relevant data for the user.

One of the features in the patent is a graphic interface showing a “Go-To” menu option in a text input window.

—The jury’s verdict: Apple failed to prove Samsung infringed on this patent.

Patent 7,761,414

—Official description: Asynchronous data synchronization among devices.

—What it really means: This patent involves a way to synchronize data across computers and mobile devices. In the case of a smartphone, this could apply to synchronizing address books on your phone with online storage.

—The jury’s verdict: Samsung did not infringe on Apple’s patent.

Patent 8,046,721

 

—Official description: Unlocking a device by performing gestures on an unlock image.

What it really means: This patent refers to a way of controlling an electronic device with a touch-sensitive display. Specifically, Apple claimed Samsung infringed on a feature of the patent that describes the swipe-and-unlock feature on iPhones.

—The jury’s verdict: Apple made its case that certain Samsung devices, including the Admire, Stratosphere and Galaxy Nexus violated patents. But the panel rejected claims pertaining to Samsung’s Galaxy S II, Galaxy S II Epic 4G Touch and Galaxy S II Skyrocket.

Patent 5,579,239

—Official description: Remote video transmission system.

—What it really means: Samsung’s patent describes a system for digitizing, compressing and transmitting audio and visual signals and then reversing the process for broadcast.

The jury’s verdict: Apple did not infringe on a section of Samsung’s patent that covers transmitting video in real time over a cellular frequency.

Patent 6,226,449

—Official description: Apparatus for recording and reproducing digital image and speech.

—What it really means: This Samsung patent refers to the kind of dual digital camera that’s become standard in many smartphones. As described in the patent, the user is able to change the direction of the camera.

The jury’s decision: Apple infringed on Samsung’s patent on several versions of the iPhone and iPod Touch.

Boy (16) nabbed for defiling 3 year old step-sister

POLICE in Kapiri-Mposhi have arrested a 16-year-old boy who is alleged to have defiled his three-year-old step sister while her mother was away.

In another development, a Chisamba man has died after he hit into a rock while riding a motor bike.

In the Kapiri-Mposhi incident, Central Province Commissioner of Police Standwell Lungu said the girl, who was left with her step brother, was defiled around 12:00 hours yesterday at Lukanda Village.

Mr Lungu said the boy was found defiling the girl by her step mother and later reported the matter to the police.

He said police have since arrested and charged the juvenile offender for defilement and would appear in court soon.

In the Chisamba incident, Mr Lungu said the deceased only identified as Lovemore of Wangwa Farms died after hitting into a stone which flew and later fell on his head and died on arrival at Liteta District Hospital.

Mr Lungu said the accident happened after the deceased who was riding an unregistered motor bike lost control due to speeding and hit into a stone which later fell on his head.

He said the deceased sustained a deep cut on his head and that the incident happened around 15:45 hours in Mwachisopola area in Chisamba.

In another incident, police in Kapiri-Mposhi are holding a farmer who hacked his friend with a hoe after a misunderstanding.

Mr Lungu said the incident happened in Mukonchi area and identified the victim as Brian Kalunga and that police were investigating the case.

He said reasons for axing the friend were not yet established but the man suspected to have axed the friends has been picked up to help with investigations.

 

Mailoni brothers’ mother fears for her life

MOTHER of the three notorious Mailioni brothers who were gunned down last year for killing over 12 people in Luano District of Central Province, is living in fear following continued attacks by unknown people.

The three brothers Mika 35, Fabian, alias Tunda, 31, and Stephano 27, were shot dead in June last year and were buried in Kabwe by security personnel.

Ms Janet Ngimu said the reasons people were attacking her were unknown but she suspects there could be some people who are against her late sons’ activities.

In an interview at her home in Kabwe’s Kawasaki area, Ms Ngimu said that people have been stonning her house at night as well as during the day and is shocked with the hostility. She maintained that she never supported her sons’ acts.

She said following the killing of her sons, she asked for forgiveness from those who suffered at their hands and maintained that their actions did not only cause fear to members of the public but to her as well.

“I am living in fear because I don’t know why people have been stoning my house but I suspect that there could be people who are still aggrieved with what my three sons were doing,” she said.

She said that apart from stoning her house, some people broke into her house and got away with a blanket, a bag of mealie-meal and other items which were donated to her by well-wishers.

Central Province Commissioner of Police Standwell Lungu said police are investigating the matter and that officers were already on the ground but warned that those found wanting will face the law.

Security officers shot dead the notorious Mailoni brothers who had been brutally killing people in Luano Valley since 2007 and are believed to have killed 12 people all of whom were stabbed using bows and arrows.

A combined team of security officers gunned down the three brothers deep in the forest, sending people in Chief Chembe’s area into celebrations after living in fear for seven years.

Among the victims of the three siblings was Zambia Flying Doctor Services (ZFDS) chief pilot Moses Masumba who was killed in cold blood.

Villagers, who lost their relatives at the hands of the three, wept while others cursed the corpses as they remembered their loved ones.

Anti Corruption Commission (ACC) has been sued

A FORMER Bank of Zambia (BoZ) employee has dragged the Anti Corruption Commission (ACC) to court over its decision to place a restriction notice on his 20 motor vehicles and other properties.

Martin Simumba has since asked the Lusaka High Court to order that the restriction notice placed on his properties in 2008 is no longer applicable and was null and void.

Mr Simumba wants the court to order ACC not to renew its restriction order and to also order that the restriction notice dated December 19, 2008 should not be renewed.

He also wants the court to reverse the restriction notice so that he could have access to his properties and that he be given damages for misfeasance in public office and an order for costs for the court proceedings.

Mr Simumba of plot number 74A Lukanga road, Roma Township stated in his writ of summons filed in the principal registry that on November 19, 2008, the ACC issued a restriction notice on his motor vehicles under the guise of investigations.

According to the restriction notice issued by ACC director-general Roselyn Wandi, Mr Simumba was being investigated on offences he was alleged to have committed under Part IV of the ACC Act number 42 of 1996.

Ms Wandi directed that Mr Simumba should not dispose off his 20 motor vehicles and properties numbered L/36650/M on title number 69104, F/669/27 on F/687/A/1/A/2/B- L8353, F./687/A/1/A/2 on title number 27675 and 4, 000, 000 shares in Fresh Direct Zambia Limited without the consent of ACC.

The motor vehicles are registration numbers AAR 8702, AAT 3188, AAX7710, AAZ 611, AAZ 612, AAZ 5271, AAZ 5272, AAZ 5275, ABC 303, ABC 304, ABC 305, ABE 4902, ABE 4903, ABE 4904, ABE 4905, ABE 5005, ABE 5666, ABJ 4275, ABJ 4922, ABE 4922 and AABJ 5092.

Investigations against Mr Simumba were instituted after BOZ lodged a complaint against him.

But Mr Simumba said on June 2009, his lawyers wrote to ACC demanding for the removal of the restriction notice and on June 15, 2009, the ACC responded that the restriction would remain in force.

He said because the restriction order has remained in force, he was unable to do a lot of transactions and his travel was restricted.

Mr Simumba said he made several other representations to ACC in which he highlighted the fact that there was no basis for the continued harassment and intimidation he was going through.

He said to date, there had been no charge slapped on him but the restriction notice on his properties had continued.

Mr Simumba described the restriction notice as abuse of authority and generally abusive on his persona and properties. He said that was why he wanted the court to intervene.


Zambia, Burundi seek Mpulungu rehab funds

THE Government has signed a Memorandum of Understanding (MoU) with Burundi to facilitate funding for the rehabilitation of the Mpulungu Harbour.

Transport, Works, Supply and Communications Minister Yamfwa Mukanga said the agreement would enable them to access resources from the European Union for the rehabilitation of the Mpulungu port.

In an interview in Lusaka, Mr Mukanga said the revival of the port was important to Zambia because it would contribute to increased trade among countries in the Great Lakes region.

Mr Mukanga said the agreement with Burundi signified Government’s commitment to the development of the Mpulungu port as it was a gateway to international trade.

“We have signed an agreement with the government of Burundi to enable us get access to the European funding so that we can rehabilitate the Mpulungu harbour on both sides from the Burundi side and our side.

“This was part of the condition from the European Union to sign an agreement with Burundi and we are now just waiting for funding from them before we can begin the rehabilitation works,” he said.

Mr Mukanga said the Government was looking for a potential investor to help Government revamp the port.

Meanwhile, Mr Mukanga said the Government was working at bringing the marine transport services closer to the people of Zambia.

He said to ensure efficient utilisation of water transport across the country, Government would soon commission 12 large water vessels for passenger and cargo on Lake Mweru, Lake Bangweulu and Zambezi River.

“In the water sector we have in the budget, the navigation of the Kafue River from Ndola to Lusaka so we have 12 boats and we have targeted June to have them commissioned on the vario

us water bodies,” he said.

 

Church must join graft fight – Wina

GOVERNMENT has asked the Church to join the fight against corruption, tribalism and lawlessness because the vices are detrimental to the development of the nation.

Gender and Child Development Minister Inonge Wina said the Church should fight vices such as corruption and tribalism, using its role of promoting ethical morals.

Ms Wina, who is also Patriotic Front national chairperson, said society should see God’s justice and ethical standard of behaviour through the Church and not for it to conceal wrong doing.

She was speaking at the closing of the 17th Board of Christian Education Congress and re-dedication of the Episcopal Residence for the African Methodist Episcopal Church in Mapepe area of Chilanga yesterday.

Ms Wina said issues of corruption, tribalism and lack of respect for the rule of law should be dealt with head-on to rid the nation of vices that are detrimental to the development of the country politically, economically and socially.

Ms Wina said the Church and Government should continue to partner to bring about positive image change, peace, unity and economic development.

She said the dedication of the Episcopal Residence which was being celebrated under the theme “Reclaiming the Empowering Legacy of the African Methodist Episcopal Church for Radical Transformation” marked a great step in the development of the church.

Ms Wina, who commended the women at the church, said the inherent female trait of cherishing life was of utmost importance to all human society adding, “women can become a great force against war and in favour of peace”.

“It is in this vein that gender equality is considered essential for sustainable development of institutions, including the Church” Ms Wina said.

Ms Wina said the kind of courage, resourcefulness, commitment and love that was characteristic of women could become a strong social force in the world where violence, bloody wars and conflicts were the order of the day.

She said her ministry would introduce programmes to enhance women’s participation in national development to see women in AMEC take an active role in the management of the church.

Ms Wina said Government would continue to work towards eradicating all forms of discrimination against women and challenged the church to help fight the high cases of gender based violence (GBV) in the country.

Ms Wina urged the church to take a stance against GBV and prevent the vice through teachings, counseling and sensitisation so that all could respect one another and live in peace and harmony.

Katongo brothers charged with murdering their mother, stabbing their father

Emmanuel Katongo Junior and his younger brother Ongani, who last weekend allegedly brutally murdered their biological mother and stabbed their father have been officially charged with murder.

Police have also charged Emmanuel and Ongani who are aged 21 and 18 respectively with attempted murder.

Police spokesperson Charity Chanda confirmed that the two assailants were charged with murder because they readily admitted killing their mother and led police officers to the place where they dumped the body.

“The two admitted on their own that they murdered their mother,” Ms Chanda said.

And police sources in Kitwe said the two would appear in court as soon as their wounded father recovered enough from the wounds sustained from the attack by his children.

The late Ms Ethel Gondwe Katongo was buried after a postmortem.
Ms Katongo, a deputy headteacher at Kitwe’s Ishuko Primary School in Chimwemwe Township was hit with the iron bar by her children and died on the spot.

The two later bundled their mother’s body in a car and dumped it in a forest plantation along the Kitwe-Ndola dual carriageway. – TIMES OF ZAMBIA.

WORLD PRESS FREEDOM DAY – BY HAKAINDE HICHILEMA

Country men and women, this year’s theme for World Press Freedom day “Media Freedom for a better future: Shaping the Post 2015 Development Agenda” should be properly situated by everyone especially by those in power.

It is undeniable that the press plays a critical role in a country’s governance as well as development agenda. This is why the Media is called the Fourth Estate, not as a “buzz” phrase. But as a critical component through which the three arms of government, that is, the Executive, Legislature and Judiciary can effectively dialogue with the civil society.

The profile of the media in the governance system, therefore, calls for a responsible media that is accountable to the people. Accountability calls for very high standards of professionalism. A free and professional press enables Government to deliver the right goods and services to its population because the press will reflect on the actual needs of the citizens.

In the words of the UN Secretary General Mr. Ban Ki Moon, “journalism provides a platform for informed discussion across a wide range of development issues – from environmental challenges and scientific progress to gender equality, youth engagement and peacebuilding. Only when journalists are at liberty to monitor, investigate and criticize policies and actions can good governance exist.”

Ladies and gentlemen, fellow country men and women, in 2013, the world press freedom index placed Zambia at 72 out of 179 countries. Within a year, Zambia has fallen 21 places to 93 out of 180 countries showing that Zambia’s press freedom record is declining. This status should worry anyone that cares about the plight of the press men and women in Zambia and the future if the media. The sad thing is that sections of the press have forgotten why they are in the media industry. They have been fomenting this closure of the press freedom space on the pretext of protecting the Zambian citizens from what they term rogue media. There is nothing like rogue media, instead where news outlets are gagged, alternatives are created. Those alternatives will not have the ability to regulate themselves because they exist outside the norm. This happens even in economics, when the economy is highly regulated, the black market thrives. This is what is happening in Zambia’s media today where journalists are not free to practice; as a result alternatives have emerged. We might not like them, but they are there because of demand by the citizens.

Now is the time for the media, to take their rightful place in this country. Public debate and discourse will only be meaningful if the media makes efforts to be professional, responsible and accountable. At the same time the Government must not act as guardians for the media. Instead, they must let the media account for their own actions by facilitating an environment that will ensure professionalism and accurate reporting. Whoever lives outside their agreed code, will have the citizens to deal with.

I have in mind the Freedom of Information (FoI) bill and the new republican Constitution. The Government is not getting the full pulse of the nation because the current media landscape is tilted towards propaganda. How does Government know what is a priority and not? If this legislative framework can be addressed, we can be assured of the right service from the media.

Punish any Government officials found to have impregnated school girls

The Basic Education Teachers Union of Zambia -BETUZ- has called for punishment of any Government officials found to have impregnated school girls.

BETUZ General Secretary Jeffrey Simuntala says this is because of the high number of school going girls being impregnated.

Mr. Simuntala says the Union will also continue to support for stiffer penalties to be meted on teachers who are found to have impregnated their pupils and students.

He told ZNBC News that the development in Kaoma where 30 pupils have gone on maternity leave at Kaoma High School makes sad reading.

Mr. Simuntala has noted that it for this reason that punishment should be extended to all culprits who contribute to disturbing of education of young girls.

Maize export ban lifted

GOVERNMENT has lifted the ban on exports of maize, says Minister of Agriculture and Livestock Wylbur Simuusa.
Mr Simuusa said in an interview yesterday that government has started issuing maize export permits to interested exporters following the issuance of statutory instrument (SI) No. 35 of 2014.

The SI revokes the ban on maize exports requiring exporters to specify the exact volume of maize, the source of the maize to be exported and the export destination of the maize, among other things.
Mr Simuusa called on maize exporters interested to ensure they get a permit or risk being arrested if they are found exporting without the permit.
“The ban on export of maize was lifted a week ago when I signed the SI,” he said.
The minister said government needed to ensure that opening maize exports does not result in increased mealie-meal prices and other grain products.
Mr Simuusa said Government is aware that the lifting of the ban on exports of maize will bring in much-needed foreign exchange in the country.
He said Zambia has vast opportunities for export markets but Government wanted to ensure the country has enough maize stock before considering lifting the ban.
The minister said government has put national food security as top priority and has been working at ensuring the country has enough stock to sustain the country before the new harvest starts.
Meanwhile, Mr Simuusa says several tenders at the Nitrogen Chemicals of Zambia (NCZ) were cancelled so that new contracts could be properly awarded to suppliers.
And Mr Simuusa said NCZ has so far produced close to 10,000 tonnes of Compound D fertiliser for this year’s farming season.
Workers at NCZ recently appealed to President Sata to help reverse the cancellation of tenders for the supply of raw materials.
Mr Simuusa said in an interview in Lusaka yesterday that the cancellation of tenders will not affect the production of Compound D fertiliser at NCZ.
“Without going into much detail, government will always insist that things should be done correctly. So, obviously, things have to be done correctly, the whole thing will be re-done,” the minister said.
He said the process of engaging new suppliers has already started and that bids have been advertised in the media.
Mr Simuusa urged the workers at Zambia’s largest fertiliser manufacturing plant to remain calm.
“I am calling on the people to be calm. I know that union leaders issued a statement [on the cancellation], but they should stay calm,” he said.
The minister said the plant has stocked enough raw materials needed for production of fertilisers.
The minister said out of over 100,000 tonnes which NCZ is expected to produce, it has so far manufactured close to 10,000 tonnes of Compound D fertiliser.
Mr Simuusa said despite the cancellation of tenders, NCZ has continued to produce Compound D for this year’s farming season.
“They have produced between 6,000 and 10,000 tonnes of Compound D fertiliser. They are supposed to produce 103,000 tonnes between now and August,” he said.
Mr Simuusa assured farmers that during this farming season there will be no delays in the distribution of farming inputs and that Government will do its best to address challenges faced in the past.
“We are all geared to make sure that fertiliser is in place in good time. We are starting early, within this month we are starting the distribution of the fertiliser,” he said.
Mr Simuusa said all farming inputs will be delivered to farmers by the end of August.

Works on $1bn North-West Railway to start

CONSTRUCTION of the US $1 billion North-West railway line is to start this year with the investor, North-West Rail (NWR) targeting the stretch between Kalumbila and Solwezi in North-Western Province for the initial part of the project.

NWR chairperson Enock Kavindele said in an interview in Kitwe recently that all was set for construction of the North-West railway line to start.

Mr Kavindele said the $1 billion North-West railway line project, which was a joint venture between NWR and Grindrod, was set to start this year under phase one.

He said phase one of the project would involve construction of the railway line between Kalumbila and Solwezi.

“The idea of starting from Kalumbila is that we have Kalumbila Mine there and there is the issue of having to transport copper concentrates from there to Solwezi where First Quantum Minerals (FQM) have a smelter,” he said.

Mr Kavindele said the development of the Kalumbila Mine and the construction of a smelter in Solwezi had raised transport business prospects in the region.

“At the moment, we are discussing with land owners settled on a stretch earmarked for construction of the railway line for possible compensation and once we are done with that, we should be getting to the ground to start the project,” Mr Kavindele said.

He said the need to construct a railway line in North-Western Province could not be over emphasised considering that the region had now assumed the status of the largest copper producer.

Mr Kavindele said with the many exploration projects currently being conducted, which would ultimately result in increased mining activities, the province was destined for greater economic boom that would demand for an improved transport network.

He said phase two of the project would involve the construction of a railway line from Solwezi to Chingola.

“At the moment, all the copper and concentrates are taken to Copperbelt by road and with the railway line in place, that will take away the traffic from the road to railway,” he said.


Father Bwalya’s court case fails to take off for the second time

Defence in the matter in which Alliance for Better Zambia-ABZ President Frank Bwalya is facing a charge of defaming President Michael Sata this morning failed to take off for the second time in the Kasama Magistrates Court.

This was after Magistrate Kelvin Soma informed the court that Principal resident magistrate Vincent Siloka who is presiding over Father Bwalya’s case is out of office.

Magistrate Soma has since adjourned the matter to 10th June, 2014.

And speaking to Mano News shortly after his case was adjourned, Father Bwalya expressed displeasure over the development.

On 1st April, 2014, defence in the matter failed to take off after Father Bwalya filed in a notice that he had engaged Sunday Bwalya Nkonde -SBN legal practitioners to represent him in the case.

Father Bwalya had told the court that his lawyers were not available as they had a criminal case in Lusaka.

On 4th March, 2014, Magistrate Siloka found Father Bwalya with a case to answer and put him on his defence.

This was after the state concluded its case by calling seven prosecution witnesses.

Facts before the court are that on 6th January, 2014 Father Bwalya defamed President Sata when he referred to him as ‘cumbu munshololwa, muwelewele, tatontokanya’ during a live Programme on Radio Mano.

Father Bwalya pleaded not guilty to the charge.

Three arrested over CDF funds in Manyinga

Three members of the Constituency Development Fund Committee (CDC) in Manyinga district of North-Western Province have been arrested for allegedly diverting building materials meant for developmental projects in the area.

 

Manyinga district CDC chairperson, Steven Chinoya, has been arrested together with two other Constituency Development Fund Committee members, Francis Fotiya and Moses Kahyata, the latter who is also a PF councilor.

 

Kabombo District Council immediate-past chairperson, Morgan Sapichi, confirmed the arrest of the civic leaders, saying the trio is alleged to have diverted iron sheets, door frames and window frames among other building materials for their personal use.

 

Mr Sapichi said Mr Chinoya has also been arrested for allegedly opening bank accounts in other people’s names where misappropriated money was supposedly deposited.

 

In Kabompo, the Council Treasurer, Director of Works, a clerical officer in the treasury department and a school teacher of Mbwambo Primary School have also been arrested in connection with the 2013 CDF funds.

 

Mr Sapichi said the central government had approved and released funds for the construction of a 1X2 classroom block and toilets at Chipanda Primary School in Manyinga district, which was delinked from Kabompo district in 2012, but only toilets have been built so far.

He said a follow-up on the matter had revealed that the funds for the project were not in the Kabompo District Education Board Secretary’s (DEBS) account and even the area Member of Parliament, Dan Chingimbu, who is also Lands deputy Minister, was not aware of where the funds went.

 

Meanwhile, a local businessman, Kenny Ndumba, has appealed to government to put in place stringent measures that will help curb the misappropriation of CDF funds for 2014 and the years that follow.

 

Mr Ndumba, who recently donated an assortment of goods to St Kalemba Mission Hospital in Manyinga district, said it is disheartening that individuals have continued to benefit from the CDF when the community, which is in dire need, is suffering.

 

High levels of deforestation ‘ dries up’ three rivers in Shiwang’ andu District

High levels of deforestation in Shiwalala village in Shiwang’andu district of Muchinga province have  threatened human and domestic animals’ existence as three rivers in the area have dried up as a result.

Shiwalala village committee secretary Godfrey Nkamba says the dried up rivers are kakoko, minkombwe and Kapububu rivers.

Mr Nkamba said that the rivers dried up because people in the areas were illegally cutting down Timber at the source of the named rivers.

ZANIS reports that the Village Committee Secretary said this during a ward development review meeting which was held at Konja primary school in Mwila Kabuswe ward over the weekend.

He said that if the venture of deforestation continues in Shiwalala village the area will robbed of its natural resources.

Mr Nkamba therefore said there is serious need for the forestry department in the district to strengthen their efforts in the fight against deforestation so as to save nature.

PF bent on dividing Bembas – Chanda

The Open Society Foundation (OSF) says the PF Government is bent on dividing the Bemba-speaking people by directly fighting paramount Chief Chitimukulu designate Henry Kanyanta Sosala.

OSF Executive Director, Sunday Chanda, has told QFM News in an interview that it is a statement of fact that the Bemba-speaking people provided a strong base for the PF, but that this base has been despised with the highest contempt possible.

Mr. Chanda says Zambians and the Bemba speaking people wish to know why the PF government is fighting their paramount chief.

He states that by fighting the Chitimukulu designate, government is in fact fighting the Bemba speaking people.

Mr Chanda adds that the ruling party is determined to dislodge Kasama central Member of Parliament Geoffrey Mwamba for resigning from government in protest over the stalemate between the government and the Bemba royal establishment over the installation of the Chitimukulu.

Mr. Chanda has called on Government to let go of the chitimukulu throne and stop dividing the Bemba-speaking people.

Mr. Chanda adds that PF will be pushing their luck too far with Kasama Central parliamentary seat by creating a by-election.

PF has failed to initiate its own developmental programs – UPND

The ruling Patriotic Front in Northern Province has dispelled assertions by UPND that it has no agenda to develop the nation.

Party Regional Secretary Everist Chellah charged that carrying on with developmental projects initiated by the previous governments does not imply that PF does not have developmental programs for the country.

Mr. Chellah added that it will be illogical and a waste of national resources if the PF government was to abandon projects started by MMD and UNIP government.

He further dispelled assertions that the party has no agenda to develop the country saying PF has a manifesto which is being used to develop the country.

Yesterday, UPND Northern Province Information and Publicist Secretary, Edward Musonda noted that the ruling PF government has lamentably failed to initiate its own developmental programs saying projects currently being implemented were initiated by the previous governments.
